“Jean Machine – Find Your Perfect Pair” Contest
1. The Jean Machine - Find Your Perfect Pair Contest runs from 9 am ET on September 16, 2013 to 12 noon ET on September 27, 2013 respectively. Entries submitted will be kept by Youthculture Inc. (the Contest Sponsors) for prize selection
2. No purchase or payment is necessary to enter the Jean Machine – Find Your Perfect Pair Contest.
3. TO ENTER: to enter the Jean Machine - Find Your Perfect Pair Contest you must have a valid Twitter account. To set up one go to Twitter.com. Go to www.vervegirl.com/contest/findyourperfectpair and upload a photo of you and your mom. Tweet from the Vervegirl.com contest page by clicking on the Tweet to enter button above. The tweet must contain the #jmperfectpaircontest and the link to the contest page on vervegirl.com in order to be considered as a valid entry. Entrants must also follow @vervegirlmag on Twitter in order to be considered a valid entry. Limit one (1) entry every 24 hours during the contest period.
4. All Entries must be submitted no later than the end of the Entry Period
5. The selected Candidate will be notified by Twitter Direct Message within one (1) days of the Draw Date at the Twitter profile indicated with their drawing entry. If a selected Candidate cannot be contacted within one (1) day, the Entry is null and void and another Candidate will be randomly selected from the remaining eligible Candidates.
6. Jean Machine - Find Your Perfect Pair Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to a Candidate’s entry. All decisions of Jean Machine - Find Your Perfect Pair Contest Sponsors are final in all matters as they relate to this Jean Machine - Find Your Perfect Pair Contest.
7. THE PRIZE: There will be five (5) prize winners. Each winner and their mom will receive one (1) Perfect Fit pair of jeans EACH from Jean Machine and styling tips by Gregory Gorgeous. Approx. retail value is $100 CDN each.
8. THE DRAW: The Draw Date at the head office of Youth Culture, located at 85 Kildonan Dr., Toronto, Ontario, M1N 3B9 will be held on or about September 27, 2013. The entries will be randomly selected from among all eligible Entries received during the Entry Period.
9. In order to be selected the winner of the Jean Machine - Find Your Perfect Pair Contest, you must, within one (1) day of being contacted, complete and return a completed Consent Form, confirming compliance with these rules and regulations (the “Jean Machine - Find Your Perfect Pair Contest Rules”), releasing the Sponsors and their respective directors, officers and agents from all liability and, except where prohibited by law, permitting the Sponsors to use the selected Candidate’s name, address (city and province) and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsors. If the selected Candidate is under the age of majority, the Consent Form must be signed and submitted by his or her parent or legal guardian. Youthculture Inc. has the sole authority and discretion to determine whether a Consent Form has been properly executed and has the sole authority and discretion to accept or refuse a Consent Form that has not been properly executed.
10. No correspondence will be entered into, except with selected Candidates.
11. Youthculture Inc. and vervegirl.com, Jean Machine, their affiliates, franchisees and each of their directors, officers, employees and agents are not in any way responsible for any lost, misplaced, destroyed, delayed, misdirected or undelivered Entries.
12. In the event of a dispute regarding who submitted an online Entry, the Entry will be deemed submitted by the holder of the e-mail account in their entry.
13. The odds of winning the Contest are dependent on the total number of eligible Entries received.
14. Candidates thirteen (13) years of age and over, who are residents of Ontario, are eligible for selection in the Jean Machine - Find Your Perfect Pair Contest. WINNERS MUST BE ABLE TO ATTEND THE IN-STORE JEAN MACHINE EVENT ON OCT. 5, 2013 AT YORKDALE SHOPPING MALL IN TORONTO.
15. Candidate’s entries are not accepted if they are employees of, or members of the immediate family of, or persons domiciled with an employee of Jean Machine - Find Your Perfect Pair Contest Sponsors, their agents, parent, affiliated or related companies, subsidiaries, divisions and promotional agencies, are ineligible. Proof of identification must be provided upon request. If the winner of the Contest is under the age of majority, the Prize must be accepted by his or her parent or legal guardian.
16. The Jean Machine - Find Your Perfect Pair Contest is subject to the applicable legislation and regulations of Canada and the relevant province(s) or territory (territories) and is void where prohibited.
17. All decisions of the Jean Machine - Find Your Perfect Pair Contest are final and cannot be reviewed or in any way appealed. Awards to successful Candidate have no cash surrender value. Jean Machine - Find Your Perfect Pair Contest Sponsors reserve the right to make reasonable substitutions for all or any portion of the prizes.
18. Jean Machine - Find Your Perfect Pair Contest Sponsors reserve the right to withdraw, amend, terminate or suspend in whole or in part this Jean Machine - Find Your Perfect Pair Contest at any time without prior notice and without liability.
19. WARRANTIES, ASSIGNMENTS AND TRANSFER OF RIGHTS: Candidate agrees and acknowledges for the avoidance of doubt, by entering the Contest, Candidate does grant, and has the permission to grant Sponsor the royalty-free, irrevocable, perpetual worldwide right and license to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, edit, modify, and otherwise exploit the entry in any way, in any and all markets, in any and all media, now known, or hereafter devised without limitation and without notice or consideration. Candidate represents and warrants that he/she is authorized to grant such rights to Sponsor, and that its reproduction, publishing, displaying and/or other use or exploitation of his/her entry submitted will not infringe on any rights of any third party, Candidate will indemnify and hold harmless Sponsor and Twitter, Inc., from any claims made to the contrary. If a Candidate submits an entry that is copyrighted by another individual, it will be the sole responsibility of that Candidate for any legal action the legal copyright holder may take against Candidate; Sponsor assumes no liability for any such action. Candidate grants to Sponsor the unlimited right to edit and publish the entry with or without credit and without compensation, unless prohibited by law, in any and all means, devices, processes, and technology, and in all language and in all media, now known or hereafter invented, contemplated or devised, including without limitation, the internet, television, film, video cassettes, video discs, and other audio-video devices, and radio broadcast and print publications for advertising, promotional, regulatory compliance and/or other purposes related to the Contest without notice to Candidate and without compensation or obligation.
20. RELEASE AND LIMITATIONS OF LIABILITY: BY PARTICIPATING IN THIS CONTEST CANDIDATE AGREES TO RELEASE, INDEMIFY, DEFEND AND HOLD HARMLESS SPONSOR, TWITTER, INC. AND THEIR PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS AND SUPPLIERS WHO ARE DIRECTLY INVOLVED WITH PROVIDING PRIZES AND/OR SERVICES IN CONNECTION WITH THIS SWEEPSTAKES, INCLUDING PROMOTIONAL AGENCIES, (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY FOR ANY INJURIES (INCLUDING EMOTIONAL DISTRESS), FROM ANY AND ALL CAUSE OF ACTION, LIABILITIES, SUITS, CLAIMS (INCLUDING BUT NOT LIMITED TO, THIRD PARTY CLAIMS THAT MAY BE MADE AGAINST CANDIDATES, AND CLAIMS ARISING OUT OF OR RELATING TO ACCEPTANCE, RECEIPT, POSSESSION OR USE/MISUSE OF ANY PRIZE, OR ANY PUBLICITY OR OTHER PUBLIC EXPOSURE OF CANDIDATES INCLUDING WITHOUT LIMITATION, CLAIMS CONCERNING INFRINGEMENT OR INVASION OF CANDIDATE’S PRIVACY OR PUBLICITY RIGHTS, OR DEFAMATION, OR ACTS UNDERTAKEN IN PREPARATION FOR, OR PARTICIPATION IN, THE SWEEPSTAKES, AND LOSSES AND/OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, OR PROPERTY ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ANY PRIZE OR RESULTING FROM AWARDING, ACCEPTANCE, NOTIFICATION, POSSESSION, USE, MISUSE, LOSS OR MISDIRECTION OF ANY PRIZE OR RESULTING FROM PARTICIPATING OR INABILITY TO PARTICIPATE IN THIS SWEEPSTAKES PROMOTION OR ANY SWEEPSTAKES PROMOTION OR PRIZE RELATED ACTIVITIES.
